FULL TERMS & CONDITIONS

  • Team Langoustine Ltd is a Reseller of Tickets and coordinator of affiliated services to facilitate combined group bookings for Customers to benefit favourable facilities and services for the Le Mans 24 Hours race, and other related Ticket sales.

    ‘Customer’ shall mean the individual or legal entity, whether for business or non-business purposes, purchasing Tickets directly from Team Langoustine Ltd as a distance sale, in which case Customers have spontaneously decided to purchase the Tickets.

    ‘Group Organiser’ refers to a Customer acting for and on behalf of a number of Customers who wish to coordinate their Purchase collectively.

    ‘Automobile Club de l’Ouest’ (hereinafter referred to as ‘ACO’) is a non-profit association (French 1901 Act) registered under French business number 775 652 316, founder, and organiser of the Le Mans 24 Hours race and various other internationally renowned Sporting Events.Société Sportive Professionnelle de l’Automobile Club de l’Ouest (hereinafter referred to as ‘SSP ACO’ or the original ‘Seller’) manages the financial side of the Sporting Events organised by ACO and the sport associations connected to ACO.

    ‘Ticket’ shall mean the pass giving access to all or part of the Venues at which the Sporting Events are held and to all or part of the organised Sporting Event, it being agreed that, unless otherwise expressly agreed with Customers at the time of Purchase, Tickets are only valid for one single Sporting Event and the period of validity depends on the type of Ticket purchased. ‘Ticket’ may also refer to the pass giving access to all, or part of the car parks and sites made available to spectators of the Sporting Events (free of charge or against payment).

    ‘Purchase’ means the purchase of one or more Tickets by Customers, it being agreed that the Tickets may be purchased immediately, or an order may be placed, with the Tickets being handed over to Customers at a later date.

    ‘Sporting Event’ means the preliminary heats (time trials or normal trials, qualifying sessions etc.) and the event itself (race) and lastly, all activities that are directly or indirectly connected to the event (concerts, fun fairs etc.).

    The ‘Venue” means the racetrack and the sport facilities that are needed for the organisation of the Sporting Events along with the other structures and spaces for spectators attending the event (such as car parks and sites), controlled by Team Langoustine Ltd.

  • These general terms and conditions of sale (hereinafter the ‘General Terms’) shall apply to the relationship between Team Langoustine Ltd and its customers (hereinafter referred to as the ‘Customers’) who wish to purchase Tickets.

    Team Langoustine Ltd may draw up special terms and conditions of sale for each Sporting Event reflecting SSP ACO requirements (prices, number of seats available at a reduced rate etc.). These special terms and conditions shall be stated in the presentation of each relevant event.

    Any forbearance or waiver by Team Langoustine Ltd and/ or SSP ACO in the application of all or some of the clauses of these General Terms, regardless of the date, frequency, or duration thereof, shall not amend the provisions hereof or create or prevent the exercise of any right, unless otherwise agreed in writing.

    These General Terms shall be sent or handed over to all Customers on demand.

    Accordingly, by completing the Purchase of a Ticket, Customers are deemed to have expressly and unconditionally accepted all of the provisions of these General Terms and the rules and regulations applicable at Le Mans circuits.

  • 3.1. General

    Team Langoustine Ltd reserves the right to amend the provisions to of these General Terms to reflect or accommodate necessities dictated by external circumstances, at any time and without prior notice.

    3.2. Administration fee to cover General Admission Tickets sourced via the ACO or other outlets

    Team Langoustine Ltd will levy an administration charge on Private Camping Customers who source their General Admission Tickets via other routes. This is due to the complex billing process from the ACO to Resellers (Team Langoustine Ltd) that includes a large annual ‘Logo Rights’ fee. This fee is offset against General Admission Ticket sales, and any shortfall added to Camping site costs.

    The Directors have decided this is the most equitable route to ensure all Private Camping customers contribute equally to the overheads.

    3.3. Exclusion and Unruly/counterproductive behaviour.

    Team Langoustine Ltd reserve the right to refuse admission to the Private Campsites and withdrawal of Tickets without any prior notice given, for extreme unruly or aggressive behaviour. This includes infringements at prior or the current event. While Team Langoustine Ltd at the Le Mans 24 hours event is a liberated experience, there is a common-sense line of behaviour that will not be tolerated.

    Team Langoustine Ltd remains a company run and managed by fans, for the fans, so efforts of individuals to undermine these cooperative efforts will also receive the same sanctions to protect the enjoyments of the majority.

  • 4.1. General provisions

    4.1.1. Use and intended purpose of the Tickets

    Customers and Group Organisers acknowledge that the Tickets have been issued for the sole purpose of granting them access to the Venue at which the Sporting Event is to be held. All other uses are prohibited.

    Tickets Purchased via Team Langoustine Ltd are for individuals and for non-commercial purposes.

    As individuals, Customers and Group Organisers state that they are not professionals in the leisure or tourism sector, nor in any other commercial sector linked to these activities and does not buy nor use the Tickets or services sold on this website for professional, commercial purposes or in general to make profit.

    Unless expressly agreed otherwise, Customers and Group Organisers are not in any way permitted to sell on the Tickets.

    4.1.2. Presentation of Tickets by the individual.

    Individual Customers will only be authorised to enter the Venue if they present their Ticket at the Venue entrance, and they must retain the Ticket in order to be able to present it at any time to any person involved in the organisation of the Sporting Event. Customers unable to present their Ticket will be refused entry to the Venue and may be ejected from the Venue.

    Individual Customers will only be authorised to enter the Team Langoustine Private Campsites if they present personal identification on initial registration that confirms their status with the personal information logged with Team Langoustine during the Ticket Purchase and issuing process. This is for security and safety purposes so Team Langoustine Ltd are aware to the best of all abilities that all individuals in the secure camping areas are duly authorised.

    4.1.3. Ticket controls

    Customers are informed, in this respect, that they will be required to follow the ticket control procedure implemented by the ACO when entering and leaving the Venue, which may involve the routine scanning of Tickets. Customers refusing to follow the relevant control procedure will be refused entry to the Venue and/or will be ejected from the Venue and will not be entitled to claim any compensation or refund, in any circumstances whatsoever.

    At the entrance of the Venue, Ticket holders agree to submit to a search of their person and to a visual inspection of all luggage (such as handbags, rucksacks etc.) and the inside of their vehicle (including the boot), by any police officer and/or any employee of the event organiser approved by the Chief of Police and may be invited to present the items in their possession. Items prohibited under the rules and regulations implemented by Le Mans circuits shall be seized by the competent authorities. The organiser disclaims all liability for any items seized by the competent authorities.

    Customers are informed that if they wish to leave the Venue during the event, they will need to obtain a voucher from the ACO or have their Ticket scanned by the ACO or follow any other specific procedure implemented by the Organiser to allow them to re-enter the Venue. Customers failing to follow the necessary steps to obtain such proof will be refused re-entry to the Venue and they will not be entitled to claim any compensation or a refund.

  • 5.1. Order process

    Orders are placed on a strictly ‘first come first served’ basis and remain provisional until the event date is released by the ACO.

    A deposit system is in place for early registers of interest, though only become an official order when payment is received in full. Team Langoustine Ltd reserve the right to sell any tickets for camping or viewing if full payment is not received in the agreed deposit timeline (see section 6).

    All payments are in GBP.

    Customers may place an order using one of the following methods.

    • Online (www.teamlangoustine.com)

    • by emailed application form (invitation only).

    Orders will be fulfilled subject to the number of tickets/pitches/seats available when the order is placed.

    Customers shall not be entitled to any refund of the costs incurred when placing an order, namely Internet charges incurred when visiting and using the website, telephone charges and postal costs. Customers may not, under any circumstances, claim any compensation for any problems affecting all or part of these order-placing methods.

    5.2. Online orders

    Customers wishing to place an order online will need to follow the steps set out below.

    When ordering Tickets online for the first time, Customers will need to create a ‘customer account’ on the website and provide all requested information. Customers warrant that all information provided on the date of registration is true and accurate. The personal data provided by Customers on behalf of themselves and their group will be used to ensure the successful completion of the transaction and future transactions.

    Moreover, the personal data may be used by Team Langoustine Ltd to contact Customers (group organiser, or member of the group), where possible, if the relevant event is cancelled or changes are made to the date, time, or place of the said event. Team Langoustine Ltd may need to contact Customers by e-mail or telephone to obtain further information on their identity (identity card) and the identity of the holder of the debit or credit card used to pay for the order, depending on the order amount and the existence of the purchaser’s address.

    Pursuant to the provisions of the French Civil Code, Customers may move back and forth within the order process in order to make changes to the information provided. The information requested from Customers is essential for the processing of their orders and will be disclosed to Team Langoustine Ltd. If this information is not provided, Team Langoustine Ltd will not be able to register the order. Team Langoustine Ltd may not be held liable for any mistakes made when providing the information or for any ensuing late or wrong deliveries. In such a case, any additional delivery costs incurred will be charged to the relevant Customer.

    In the event of a long period of inactivity on the website, items chosen prior to the period of inactivity may be removed from the shopping basket. In such a case, Customers will be invited to start again and to place a new order.

    In order to validate their order, Customers will need to read the general terms and conditions of sale and accept them by ticking the relevant box.

    Once an order has been validated by a Customer (constituting a final and binding undertaking by the Customer), the Customer will receive an order acknowledgement. Accordingly, all Customers must provide a valid e-mail address. Order acknowledgements inform Customers that their order has been processed and validated by Team Langoustine Ltd and paid for by them (subject to the validity of the transaction and payment).

    Team Langoustine Ltd reserves the right to refuse any order for good reason, in particular in the event of problems with the payment, potential delivery problems, abnormal orders or orders placed in bad faith and, where applicable, the right to demand the provision of supporting documents.

    Under article L121-21-8 of the French Consumer Code, the right of cancellation cannot be exercised for the purchase of tickets required to access a sporting event with a definite date or period.

    5.3. Emailed application form (invitation only)

    Customers wishing to place an order by a digital application form will need to follow the steps set out below. This is advisable for complex multi pitch camping requirements.

    Request an application form via telephone or email and follow the instructions sent by Team Langoustine Ltd member and return the application form filled in with details requested.

    Team Langoustine Ltd will validate the application form by contacting the addressee on the application form.

    All other terms in 5.2 above apply.

  • Tickets shall be purchased for the price in force at the time of their Purchase. All prices are stated in GBP.

    Ticket prices do not include delivery charges and Tickets will only be sent via a secure mail service.

    Customers may pay the full price of their Tickets at the time of Purchase by any method of payment accepted by Team Langoustine Ltd, with no discount or reduction.

    If Tickets are reserved by any method the reservation must be paid in full within 30 days of initial order, Team Langoustine Ltd withhold the right to cancel, by operation of law, with no prior notice or reminder. In such a case, Team Langoustine Ltd may sell the relevant Tickets (reserved but not paid for) to any other person, at its own discretion.

    Customers utilising www.teamlangoustine.com for Ticket Purchases will be required to provide their sixteen-digit card number and the expiry date printed on the front of the card along with the card security code printed on the back of the card. Credit and Debit cards accepted may vary from time to time due to external forces.

  • Prices charged at the time of the Purchase do not include any forms of Customer travel insurance.

    Team Langoustine Ltd recommend that Customers or Group Organisers investigate insurance to cover travel and postponement/cancellation of the Event whereby a Customer may be at a loss or unable to attend. Team Langoustine Ltd will not be liable for any costs or damages in event of any interruption to the service.

    Public liability and financial protections insurance for Team Langoustine is in place for each event.

  • 8.1. General provisions

    Tickets will not be delivered until they have been actually paid for in full and made available to Team Langoustine Ltd by the ACO.

    The method of delivery depends on the time remaining between the date of reservation and the date of the relevant Sporting Event.

    Purchasers may choose between several methods of delivery for the purchased Tickets, such as:

    • Dispatch, via a special mail service such as UPS (secure mail service), of the Tickets to the address provided during the Purchase process, subject to an additional delivery fee and service charge, the amount of which is set by Team Langoustine Ltd and disclosed in the order process.

    • Print-at-home E-Tickets (when available)

    Customers acknowledge and accept the fact that the Tickets they have ordered and paid for may be delivered several months after payment and that this does not affect the validity of the transaction or constitute a ground for compensation, it being agreed that the Tickets will be delivered before the start of the relevant Sporting Event or with prior arrangement made available for collection by the Customer from Team Langoustine Ltd official campsite, at no extra cost and subject to proof of the Purchase, on the day of the event.

    8.2. E-Tickets (when available)

    The provisions of Clause 8.1 and all the provisions of these General Terms also apply to E-Tickets.

    Each E-Ticket has a barcode which can be used to admit one spectator only to the event.

    E-Tickets are only valid if they are printed in full on white A4 paper that is printed on one side only, without modifying the print size, using the portrait orientation (vertical), and using an inkjet or laser printer. Customers are strongly advised to print out E-Tickets in black and white only. No other medium may be used (electronic, PC screen, mobile phone screen etc.). The print quality of the E-Tickets must be good. E-Tickets that have only been partially printed or that are dirty, damaged, or unreadable will not be accepted and will accordingly be treated as invalid. If the print quality is substandard, Customers must reprint their E-ticket(s), at their own expense, with a good print quality. The Seller disclaims all liability for any problems encountered with the printing of Tickets.

    E-Tickets are personal and non-transferable. When E-Tickets are scanned at the Venue entrance, Customers may be asked to produce an official and valid form of photo identification to identify the purchaser of the E-Ticket. E-Tickets are only valid for the place, the Sporting Event, the seat, the date, and the time specified. They are not valid in any other circumstances. Customers must retain their E-Ticket until they leave the event Venue.

  • Lost or stolen Tickets will not be refunded by Team Langoustine Ltd or the ACO, even on production of proof of the Purchase. Moreover, if a Customer is unable to attend all or part of the Sporting Event for personal, medical, or technical reasons or for any other reason whatsoever, the Ticket and/or the E-Ticket will not in any way be refunded by Team Langoustine Ltd or the ACO, even on production of supporting documents. Likewise, no refund will be given for damaged Tickets and/or E-Tickets that cannot be scanned.

    Team Langoustine Ltd will not take back or exchange purchased Tickets and/or E-Tickets.

    If the Sporting Event is cancelled or infrastructures requiring access passes are unavailable, for any reason whatsoever, the ACO shall have sole authority to decide whether the relevant Tickets will be refunded and the terms of any refund.

    Team Langoustine Ltd is entitled to deduct a fee from all refunds authorised by the ACO in order to cover Team Langoustine Ltd’s unrecoverable third-party non-refundable infrastructure campsite overheads, plus administration and processing costs.

    In any case, even if Tickets are refunded, Team Langoustine Ltd or the ACO shall not be liable, in any circumstances whatsoever, to pay any other type of compensation.

    Likewise, no full or partial Ticket refunds will be given in the event that the Sporting Event lasts for more than one hour. Customers are informed and accept the fact that the ACO as Organiser of the Sporting Event is permitted to modify the length and schedule of the Sporting Event at any time and at its own discretion and that this does not in any way give Customers the right to claim a full or partial refund of their Tickets.

  • In the event of a non-payment, outstanding payments or rejected debits (other than those caused by technical problems that are not attributable to the Customer), Team Langoustine Ltd shall be entitled to refuse to issue the Tickets to the Customer with no prior formalities. In such a case, Customers will no longer be able to claim any of the rights or services to which Tickets holders are entitled.

    Team Langoustine Ltd may require Customers to reimburse all bank charges and ancillary costs incurred by Team Langoustine Ltd.

  • In the event of a Purchase of Tickets granting admission to the Venue where the circuits are located, Customers are informed of the fact that they will need to comply with the rules and regulations applicable to Le Mans circuits and Team Langoustine Ltd Private Campsites. If they fail to comply with the said rules and regulations, or at Team Langoustine Management discretion, Team Langoustine Ltd or the ACO may have them ejected and refuse them entry to Campsites and/or the Venue for the duration of the Sporting Event or longer, immediately and by operation of law and with no requirement to give prior warning.

    If Customers fail to fulfil their obligations set out in Clause 4 hereof, the ACO and/or Team Langoustine Ltd shall terminate the relevant contract, by operation of law and with no prior notice.

    The ACO of the Sporting Event reserves the right to take legal action against such Customers.

    Following the termination of the contract, Team Langoustine Ltd and the ACO will not be liable to pay any compensation or to give any refund.

  • The Customer can appeal to mediation in case of a consumer dispute linked to a purchase from Team Langoustine Ltd. In accordance with the mediation provisions, any consumer dispute must be sent in advance and in writing via email to Team Langoustine Ltd, Team Langoustine Ltd will give the Mediator’s contact details through a simple request.

  • Personal information collected when Customers register themselves and their group members online will be processed by Team Langoustine Ltd using an automated system and are essential for the processing of Customer requests. It may be disclosed to Team Langoustine Ltd’s partners.

    Team Langoustine Ltd complies with the rules in force in the UK on the confidentiality of the information.

    Customers have the statutory right to remove or correct their personal information and accordingly, may have their personal information that is no longer relevant deleted, by sending a written request to Team Langoustine Ltd or email to theguys@treamlangoustine.com.

    Customers have the right to prevent their personal data from being processed for direct marketing, in particular for commercial purposes, at their own expense.

    Cookies record certain information which is then stored on consumers’ hard drives. Cookies never contain confidential information such as their name or card number but allow items selected during a previous visit to be stored for future visits.

  • Customers undertake not to apply to register any trademarks owned by ACO or Team Langoustine Ltd in any country and in any class whatsoever.

    Customers undertake not to in any way infringe the trademarks owned by ACO or Team Langoustine Ltd and in particular not to damage the value or reputation of these trademarks.

    Moreover, Customers may not exploit ACO’s image, or the image of the Sporting Events organised or co-organised by ACO, for any purpose or use whatsoever. In particular, Customers undertake not to create any product (including those created for IT purposes only) containing ACO’s trademarks or image.

    All persons attending, or authorising any minor under their responsibility to attend, events that are directly or indirectly organised by SSP ACO hereby consent and grant to the organiser, free of charge, the right to use and reproduce their image and voice (or those of the minor under their responsibility) on any medium in connection with the event and/or the promotion of the organiser’s sports Venues and activities, such as photographs, the broadcasting of the event on television or large screens, programmes and/or video or audio recordings, for at least ten years worldwide, automatically renewable for further three-year periods until terminated. Customers wishing to terminate this authorisation must inform ACO of their decision by letter sent by registered post with acknowledgement of receipt, giving six months’ notice prior to the date on which the authorisation is to be automatically renewed.

    The general public is also informed that for their safety, all the Venues for the Sporting Event may be fitted with video surveillance systems monitored by police officers and may be produced as evidence for criminal proceedings. A right of access may be exercised in accordance with the provisions of Article 10V of the French Act of 21 January 1995.

  • If one of the clauses of this contract is invalid, this shall not affect the validity of the contract or the other clauses.

    If one of the parties fails to require the full performance of certain clauses and/or provisions of this contract, this shall not in any way entail a novation of this contract as regards the said clauses and/or obligations and they shall remain in full force and effect unless otherwise agreed in writing.

  • These General Terms and the special terms and conditions applicable to the ACO are governed in full and in all respects by French law.

    These General Terms and the special terms and conditions applicable to Team Langoustine Ltd are governed in full and in all respects by UK law.
